A surviving family member is not entitled to succession rights to the decedent's Section 8 tenancy under either federal or state law, ruled the New Jersey Superior Court, Appellate Division. (Maglies v. Estate of Bertha Guy, 2006 WL 1932350 (N.J. Super. AD.), July 14, 2006) Sherri Jennings, the daughter of Bertha Guy, a participant in the Section 8 voucher program, moved in with her mother about four years before Guy died. Jennings was not a party to the lease or the housing assistance payments (HAP) contract among the landlord, Guy, and the Department of Community Affairs, but she was designated in both documents as an occupant of the apartment.
