建设单位的法律责任及其风险评估

摘要

Laws and regulations of construction established for construction companies are reviewed. Legal liabilities of construction companies in the design &application stage,the bidding stage,the construction stage and the inspection,acceptance & maintenance stage are elaborated. Then,the Delphi method and the AHP method are adopted to identify and evaluate legal risks for a training center project in Xi’an. Finally,a conclusion is made that collusive tendering is at the highest risk for this project.%梳理了在建设过程中，建设单位使用的各类法律依据，同时详述了征地设计报建阶段、招投标阶段、施工阶段、验收保修阶段的建设单位法律责任，结合西安某培训中心工程，运用德尔菲法和AHP法对建设单位法律风险进行了辨识和评估，得到了建设单位对于该工程串通投标的法律风险最大的结论。
