我国传统文化中知识产权产生与发展不利因素分析

According to the view of new system economics,traditional culture is the informal and recessive system;Intel-lectual property is the formal and dominant system. Chinese traditional culture as a kind of informal system,carries many adverse factors affecting and restricting the produce and development of the intellectual property system. It is especially im-portant that we deeply understand these adverse factors and the influence on strengthening the construction of intellectual system today.%按照新制度经济学的观点，传统文化是非正式制度，是一种隐性制度；知识产权是正式制度，是一种显性制度。我国传统文化作为一种非正式制度，其中有许多不利因素影响和制约着知识产权制度的产生与发展，深刻认识这些不利因素和影响，在不断加强知识产权制度建设的今天意义尤为重大。
