非专利实施主体的发展及其对我国专利运营模式的启示

摘要

For the past few years the rapid development of non-practicing entity has had an important impact on the economy and the society,and aroused the attention of many countries in the world,Chinese enterprises,especially those medium-sized and the small ones need to make best use of the advantages and bypass the disadvantages to face the challenges from the non-practicing entity,and avoid the obstacles to technological innovation in various industries.This paper will analyze the type,the operation mode and the main effect of the non-practicing entity,take Intellectual Ventures as an example to study its development and discuss the possible impact on the domestic enterprises,learn from the legislation and practice on the regulation of the non-practicing entity in some foreign countries and regions,propose feasible measures to establish and improve China's patent operation mode,and put forward suggestions for the future development of patent operation mode in China.%近年来非专利实施主体的迅速发展对经济社会产生了重要影响,引起了世界各国的关注,我国企业尤其中小企业需要扬长避短应对非专利实施主体的攻势,避免阻碍各产业的技术创新.分析非专利实施主体类型、运营模式及其带来的主要影响,以高智公司为例研究其发展历程、讨论其对国内企业可能造成的影响,借鉴国内外关于规制非专利实施主体的立法和实践等,从而提出建立和完善我国专利运营模式的可行性措施,并对我国专利运营模式未来的发展等方面提出建议.
