网络版权技术措施的保护模式与例外

网络版权技术措施的保护模式和程度，取决于立法者如何平衡版权保护与公众权利之间的关系。在保护版权人的技术措施问题上，各国根据自己的立法理念和利益立场，尺度不一。我国对技术保护措施的保护较为粗陋，从立法技术上而言，应当区分访问控制措施和版权保护措施。在设定规避技术措施的责任问题上，应当对侵权行为的构成各要件进行更为细致的规定，包括有效技术措施的要求、规避行为的界定、过错等等。同时，合理使用制度作为平衡版权人和公众的重要手段，在技术措施保护过程中仍然应该得到尊重。%The legal status of technical protection measures largely depends on the balancing of interest between copyright holders and the public. In China, the rules of technical protection measures are relatively rough. Specificaly, the protection of copyrights and technical measures should be distinguished. In the setting of rules, the infringement of the technical protection measures should be identified more closely, including the standard of effective technical measures, the circumvention, and the role of fault. At the same time, the fair use rule should also apply in the whole process.
