控规调整论证角色安排与对策探讨

摘要

Evaluation is fundamental in regulatory planning revision.Different roles in current evaluation shall be reconsidered and the mechanism needs reform.First,the paper analyzes the dual identities of evaluators and indicates the contradiction and problems in the evaluation;second,with three hypotheses of evaluators and their roles,the paper analyzes their efficacy and feasibility and puts forwards a market oriented role play of evaluators;then,the right and responsibility of evaluators are defined with an analogy of judicial litigation;last,the paper indicates the risk of market oriented evaluators and proposes an institutional mechanism for impartial evaluation.The mechanism highlights the role of censorship and management in the evaluation.%控规调整的论证工作对控规调整工作起到了至关重要的基础作用,针对当前论证机制的不完善以及由此引发的问题,应重新思考论证角色的安排和相应的对策.文章首先分析当前控规调整管理中论证角色安排的弊病,表现为论证者双重身份之间的冲突,以及由此造成的存在矛盾的论证权责和作用;其次,基于论证主体和论证作用提出重新安排论证角色的三种假设,并论述了三种假设下论证机制的有效性与可行性,由此提出论证角色市场化的最优方案;再次,类比司法诉讼中各主体的关系,对市场化的论证角色的权责进行界定;最后,援引法学界围绕律师责任的探讨,认清市场化的论证角色存在的风险,并提出实现论证权责的制度机制途径,强调发挥管理者对论证进行严格要求和严格审查的核心作用.
