港口工程建设行政许可权限之争——以宁波—舟山港为例

There are regulations concerning the plan, construction approval, and administrative penalties of port construction in different laws. In reality, however, project developers are difficult to make clear of the procedures and pertinent administrative bureaus, and different laws contradict on certain items in their explanation and application. This may lead to difficulty in real estate registration after port construction is completed. With Ningbo-Zhoushan port as an example, the paper analyzes relevant laws and regulations, lists the procedures of port planning, project design, approval, and completion, indicates the difference between port construction project and common construction project, and points out the weakness of real estate registration. With consideration of present laws, regulations, and practical conditions, the paper proposes cooperation between planning-construction and administrative management, and solutions to contradictions between real estate registration and port construction. It provides a reference for port construction and management.%《中华人民共和国港口法》、《中华人民共和国城乡规划法》及配套法规都对港口工程建设的规划、建设许可和行政处罚等管理内容做出了规定,但在实际工作中,建设单位仍不清楚该向哪个行政管理部门申请许可,行政管理部门对两部法律的理解和适用也存在着分歧.港口工程竣工验收后,建设单位由于对不动产登记相关法规中名词的理解不同,导致无法办理不动产登记手续.基于此,文章以宁波—舟山港为例,通过解读相关法律法规,对港口规划、城乡规划的编制与审批,以及港口工程建设、城乡工程建设的审批与竣工进行系统梳理,分析港口工程建设与城乡工程建设管理的差异,同时指出不动产登记过程中存在的不足.在此基础上,结合现行法律法规,从实际出发,提出规划建设与行政管理之间协作配合的工作思路,并就不动产登记管理与港口工程建设之间的分歧提出解决策略,以此为港口管理与建设提供参考.
