论体育公共服务中的政府权力及其控制

The exercise of government power in sports public service is a key issue. If improperly used, it will make the rights and interests of individual sports threatened or abused, so the exercise of government power in this area should be controlled. From the universal law, the operation of the authority of government should follow certain principles, otherwise we will lose the specification and order. According to the general requirements, it should follow the democratic constraints, the rule of law and the principle of responsibility and should have a lean, efficient, scientific and fair run the program, strengthen procedural mechanisms of social participation, to make government more efficient and more power efficient. Overall, the government power over public sports service should adjust power allocation in the future on the basis of past experience and according to the law as soon as possible, implement necessary centralization and decentralization to achieve the right control, and establish the government monitoring and accountability mechanism to hold officials accountable.%体育公共服务中政府的权力运行是一个贯穿体育领域建设法治型服务型政府的关键问题。权力运用不当可能背离、威胁甚至侵害个人体育权利和权益，体育公共服务领域的政府权力控制实际上是政府权力与个人权利关系的处理问题。从普遍规律看，政府权力的运行都应遵循一定的原则，否则就失去了规范和秩序。按照一般要求，应遵循民主、制约、法治和责任原则，并应拥有精简、高效、科学、公正的运行程序，加强社会参与的程序机制建设，使政府权力更快捷更高效地服务体育公共服务实践。总体来说，未来的体育公共服务中的政府权力应当在总结经验的基础上尽快依法调整权力配置，必要的集权与适当的分权相结合，实现控权功能，尽早建立政府责任监督与追究机制，坚决依法治吏。
