The study of formative theory of administrative action has been kept in the shadow, and we should probe into this issue under the background of continually prosperous public-private partnership (PPP). On the one hand, we should probe into the mode of public-private partnership with the help of administrative theory, interpret it on the base of traditional dualism of“public and private”, and demonstrates the constitutional base of such a mode. On the other hand, we should propose a new formative theory of administrative actions on the base of PPP, demon⁃strate the connotation and role of administrative actions both on a formative base and a informative base, and recon⁃struct the system based on the theoretical connotation.%行政行为形式理论在行政法学界一直处于研究的“冷门”，在公私合作模式日益发展的今日，有必要对行政行为形式理论进行深入探讨。一方面，需要在行政法理论基础下透视公私合作模式，并且将其置于传统公私二元论下进行解读，阐明并论证这种模式的宪政基础。另一方面，必须以公私合作为背景重新提出行政行为形式理论，并且从型式化和非型式化两种学理分类论证行政行为形式在公私合作进程中的内涵和地位和，并且基于该理论内涵对其进行框架性的制度重构。
