[目的/意义]情报在国家竞争中的地位愈加重要，世界各国都在不断优化自身情报体制，我国相关情报立法相对滞后。从比较法角度研究情报立法有助于推动我国情报立法。[方法/过程]在对我国情报法律制度梳理的基础上，把我国情报立法工作与美国等国家地区的情报立法工作相比较，指出我国情报立法的不足与问题。[结果/结论]最终结合我国国体政体对情报立法工作提出了方向性改进建议：国家情报体制的建构与一国的国体政体紧密相关，没有标准的模式可以借鉴，但是参考他国经验不仅具有理论意义，而且还具有战略价值，不是要对标看齐，而是要攻防应对。%Purpose/Significance] Intelligence is becoming more and more important in the national competition and countries around the world are constantly optimizing their own intelligence system. Analysis from the perspective of comparative law is helpful to promote the improvement of intelligence legislation in China. [ Method/Process] Based on the analysis of the legal system of intelligence in Chi-na, this article compares the intelligence legislation of China, the United States and other countries and points out the problems presently existing in China. [ Result/Conclusion] The author proposes suggestions on future improvement direction:the construction of national in-telligence system is closely related to its state system and regime;though there is no standard model readily available for reference, refer-ring to the experience of other countries has both theoretical significance and strategic value, it is not to be on par, but to deal with the at-tack and defense.
