论版权技术保护措施信息安全遵从义务——以法国《信息社会版权与邻接权法》第15条为视角

摘要

法国议会于2006年通过了《信息社会版权和邻接权法》以有效保护网络环境下内容产业版权和相关权利。法案在确认版权技术保护措施的法律地位同时，为防止不当技术保护措施应用危及公民、法人和其他组织利益、社会公共利益，甚至国家安全，在第15条针对版权技术保护措施的应用问题向技术保护措施相关利益主体提出了一项新的义务，即信息安全遵从义务。该条款虽并未引起社会广泛讨论，但对解决知识产权与信息安全间的冲突提供了较好的路径。也可为完善我国著作权立法提供借鉴。%In 2006, the French Parliament passed the Law on Copyright and Related Rights in the Information Society in order to provide the effective protection of the copyright and related rights of the content industry in the network environment. While the Law confirmed the legal status of the copyright technology protection measures, in view of the problems in the application of the copyright technology protection measures, the Article 15 of the Law puts forward a new obligation, that is, compliance obligations of information security to the related interest agent of the technology protection measures in order to prevent the harm of the improper application of the technology protection measures to the interests of the citizens, legal persons and other organizations, even to the state security. Although the clause has not been discussed widely in the society, it provides a better path to solve the conflicts between intellectual property and information security, and also provides references for improving copyright legislation in China.
