论中标通知书发出后建设工程合同的本约属性

When the letter of acceptance is issued,the contract is established and effective,but there is a considerable controversy about whether it is a pre-contract or a complete contract in theory and practice. In this paper,according to the distinguishing standards of pre-contract and complete contract,discusses the nature of establishment of the contract after the issuance of the letter of acceptance,from aspects of the concept of pre-contract,the intention of bidding,the content of bidding documents,liability for breach of contract and rights protection of parties and so on,to provide the reference for professional.%中标通知书发出后合同成立并生效，但此时的合同是预约合同还是本约合同在理论和实践中存有较大争议。本文依据预约和本约的区分标准，从预约合同的概念、招标投标的目的、招标投标文件的内容、违约责任的设定及当事人权利保护等方面，对中标通知书发出所成立合同的性质进行了分析探讨，供业内人士参考。
