PPP项目应用联合体模式的法律问题研究

摘要

具备不同资质条件的成员单位组成联合体共同参与PPP项目是我国目前社会资本方的重要主体形式.在分析PPP项目联合体组织形式法律属性和其应用的必要性基础上,阐述社会资本以联合体形式参与PPP项目涉及的法律问题,提出应以"有限度的、可退出的"连带责任形式对现有法律规定进行改造.%The federation of the members having different qualifications participate in PPP together is the main form of social capital in China at present. The paper expounds the legal issues of the joint venture application in PPP project on the base of analyzing legal attribute and necessity of its application of joint organization form in PPP project,proposes the"limited and quitted" form of joint and several liabilities to reform the existing legal provisions.
