Objectives: To discuss the ability of informed and consent of limited civil capacity patient and the relevant medical decision making strategy by the status of informed consent over 10 years old patients. Methods: 1050 more than 10 years and less than 18 years old patient during July and December in 2010 in outpatient departments in Lishui Central Hospital were selected. The status of no guardians accompanied, the ability of informed consent and the relation between patient s (including their guardians) informed consent and the results of medical treatment were analyzed. Results: 309 patients are not accompanied with their guardians ,there are 290 people are in high school or secondary school, their rate of not accompanied with the guardians(74.94%) is much more than people who are in primary school and in junior high school; the rate of the patients knowing their own bodies' situation is 75.95%,compaired with patients in high school and junior high school(99.74%) or patients who are already adults(98.49%),there is no big difference, "current mode" have made 289 out of guardians' accompanied patients' right invalid and then they can not get certain medical cure measures in time. Conclusions: The concept of denying the civil conducting capacity limited patients' right to know their own bodies condition and the current mode is not consistent witn Glivil Law and the originai spirit oi being iniormed and being able to make decision" , the medical side should pay enough attention and respect to these civil conducting capacity limited patients.%目的:以十周岁以上未成年患者的知情同意现状为例,探讨同内限制民事行为能力患者的知情同意能力以及医方相应的诊疗决策策略.方法:对本院门诊科室在2010年7～12月间接诊的1505例10周岁以上未成年患者的脱离监护情况、知情能力以及"目前模式"下患方(患者及其监护人)知情同意意见与医方实施诊疗措施结果间的关系进行调查.结果:脱离监护患者共309例,其中290例为高中及中专组患者,该组脱离监护率(74.94%)显著高于小学组(1.48%)和初中组(1.97%);患者充分知情率为75.95%,其中高中及中专组患者充分知情率(99.74%)和成年组(监护人)充分知情率(98.49%)无显著差异;"目前模式"使289例脱离监护患者的知情同意无效而不能及时实施相关诊疗措施.结论:否定限制民事行为能力患者知情同意资格的"目前模式"不符合国内民法精神和知情同意本义,建议医方行诊疗决策时应对限制民事行为能力患者的知情同意意见给予足够的尊重.
